Kogi Tribunal Report: INEC Lawyer Seeks Dismissal of SDP Petition
The lawyer representing the Independent National Electoral Commission (INEC) in the Kogi State Governorship Tribunal, Mr. Kanu Agabi (SAN), has asked the tribunal to strike out the petition filed by the Social Democratic Party (SDP) for lack of merit, incompetence, and inconsistency.
According to Agabi, the petition should be dismissed in line with recent Court of Appeal and Supreme Court judgments in similar cases, including Tonye Cole vs INEC and David Obumgadu Abure vs INEC.
Furthermore, the defense counsel for Governor Ododo urged the tribunal to strike out the SDP petition for being filed out of time, citing evidence received from the Central Bank of Nigeria (CBN) and admitted by the tribunal. The counsel argued that the petition is incompetent and statute-barred under the Electoral Act, and therefore, the tribunal should not waste its time on it.
This development is a significant twist in the ongoing legal battle in the Kogi State Governorship Tribunal.
